New California Law Compensates Victims of Elder Financial Abuse

California Governor Jerry Brown has signed a bill which allows victims of elder financial abuse to recover attorney’s fees and expenses. Prior to the passing of AB 381, California law allowed for double damages for elder victims of theft or fraud. The problem was that sometimes, even with double damages, the cost of litigation could exceed the amount of any recovery thereby discouraging elders from filing a lawsuit. Now, with AB 381, senior citizens can file suit with the potential of recovering attorney fees making such cases more palatable for trial attorneys.
